Debate about the criminal case against Aaron Swartz have swirled around the Internet for more than a year, but his death on January 11th raised the discussion to a new and more difficult level. Many incidents of alleged illegal downloading of copyrighted material have been prosecuted before, but none have centered around such a high profile defendant who had accomplished so much good for the public Internet. At least one person directly involved in the case believes that a lack of computer network security at M.I.T. was a mitigating circumstance. But can an open computer network really encourage people to commit crime?
